For those that don’t know, Mark Mangino has hired an attorney and they’ve begun negotiations on a buyout. They’ll be moving quickly. It’s yet to be disclosed whether or not he’ll be leaving for Austin tomorrow as neither side is budging on contract issues, but it’s only a matter of time at this point. Knowing that, let’s take a look back at the emotions of a Kansas football fan during the Mangino era.
December 2001 - We just hired a guy that coached Josh Heupel to winning a national championship. At this point, we would have taken just about anyone other than Terry, but to get a guy that can do that with Heupel…home fucking run!
2002 - Well…the results aren’t any better, but we’re finishing games and things at least feel promising.
September 27, 2003 - #23 Missouri 14 Kansas 35. Absolutely gorgeous. This is our guy.
December 2003- We’re going to a bowl! Sure, it’s called the Tangerine Bowl, and it’s in the shithole known as Orlando, and Philip Rivers is about to face rape our defense, but he got us to a bowl. Who could ask for anything more at this point…
October 9, 2004 - Kansas St. 28 Kansas 31. And the losing streak is officially broken. Snyder is beginning to wither away and we’re just getting going. Only good can come of this.
November 13, 2004 - #6 Texas 27 Kansas 23. BCS!! Dollar signs! That’s what this was about. Add in the throttling of the Tigers in Columbia the week following (31-14) and all of the losses were forgiven. After all, despite going 4-7, only @ Oklahoma was a double digit loss, and even that was 14-10 at halftime. We’re getting there, but we just don’t quite yet know how to win. Got to get that quarterback situation settled.
December 23, 2005 - Houston 13 Kansas 42. Fort Worth Bowl Champions! Yes, that’s how far Terry lowered the bar. Sure, we only beat a C-USA team, but we’re beating our rivals, gaining on floundering Nebraska and we won a bowl game for the first time in a decade
2006 – Golden Boy Kerry Meier has arrived and it’s only a matter of time before we’re dominating this conference… Just as soon as we figure out how to win at Toledo. Then he gets injured and we go on a four game mid-season losing streak, all in which we held fourth quarter leads. Why can’t this team learn how to win?
Then off comes to redshirt of Little Texas, Todd Reesing. Just as soon as it happens, and he leads us to victory over Colorado. Kerry returns to dominate Iowa State in Ames and Kansas State in Lawrence. Now we’re off to Columbia at 6-5, playing for bowl certainty for the 2nd straight year. After a costly offsides penalty as they were punting to give us the ball back at 20-17 (when we had all the momentum), we end up falling apart and getting crushed, 41-17. This felt like a big step back. Kerry was supposed to be our savior and instead we’re not even going bowling and we’re not sure if he’s even our best quarterback.
September 2007 - Apparently, he isn’t. At least not in this offense, because Todd Reesing is named the starter and we’ve just outscored our non-conference opponents 214-23. Sure none of them were any good, but if you’re watching the games, you’re seeing what’s going on. This isn’t just a product of an easy schedule, this is a really good team. And they proved as much, running off 7 more victories and climbing as high as #2 in the nation as they’re set to play Missouri for the right to be ranked #1 (with LSU having lost the day prior). Holy shitballs, this is not real. Honestly, it all felt like gravy after the 76 point throttling of Nebraska. Not only have we turned the corner, but we’ve headed clear the fuck out of town.
January 3, 2008 – Virginia Tech 21 Kansas 24. Orange Bowl Champions! On a scale of 1-10, we’re a 35.
August 2008 - We enter the season ranked #14 in the country. Unfortunately, we wouldn’t quite live up to that billing, as our pass defense wasn’t ready for what hit them in the Big XII. Who told Texas and Oklahoma they were allowed to run the spread? But hell, we still hammered Kansas State, beat Missouri and finished with a dominating Insight Bowl win for an 8-5 record. Sure, we all wanted better. But thems the breaks and we’ve got everyone on offense back next year.
October 10, 2009 – We’ve just narrowly escaped Iowa State on the heels of a record-breaking offensive performance. But hey, we’re 5-0, ranked #16 in the country and we can score on anyone. We just need to figure out how to stop someone. Hell, even if we still haven’t improved enough to battle with the south, we’re still going to sweep the north.
October 17 2009 - Fuck. Really, we lost to Dan Hawkins. Sure upsets happen, but if we’re going to contend, we have to beat this Colorado team. From the moment that final ball drops to the ground, this feels like more than one loss, maybe too much to recover from.
October 24, 2009 - Never thought I’d see my Todd play like that… Guess we just weren’t ready for that defense. But amazingly, Nebraska just lost to Iowa State, Missouri still hasn’t won and everyone else sucks. We’re still in good shape, especially if we can steal one in Lubbock.
October 31, 2009 – What in the hell was that?!?! How does a 21-14 4th quarter lead turn into a 3 touchdown loss? Todd’s groin is hurt even worse than we thought – to the point he’s being benched – but somehow, amazingly, the north is still ours if we can just beat KSU, Nebraska and Missouri. Not a very daunting task, despite what we’ve seen lately.
November 7, 2009 - OK, that was pathetic. Neither team deserved to win that abomination. But oddly, a winner was still granted. And that winner was Snyder’s Wildcats. We have hit rock bottom.
November 14, 2009 – We may have hit rock bottom last week, but this one hurt more. To watch our seniors go out with a loss like that and our coach not fight until the bitter end for them…we’ve officially regressed and I’m just not sure how we recover. This feels like 2006 all over again.
November 16, 2009 - Lew Perkins holds a team meeting without Coach Mangino to inform them that an investigation of their coach is underway.
November 17, 2009 - The shit officially hits the fan. In a matter of hours, it’s apparent that there’s no recovery from this for Mangino. None of us even have the full story yet, but we know that we’ll have a new coach no later than next season.
November 18, 2009 - The smear campaign hits another level. Ex-players, parents, you name it…the media is reaching out to anyone they can get their hands on and those coming to Mangino’s defense are few and far between.
November 19, 2009 - Mark Mangino hires an attorney and the buyout negotiations begin. In 40 days we went from 5-0, when our biggest concern was a disappointing defense….all the way to 5-5 (on the way to 5-6) and looking for a new coach. The standard evening drinks may not cut it for a while.

You left off the 2005 game in Austin when Vince decided that he wanted to pay Mangino back for his comments in 2004. I think it was 52-0 at the end of the first half.

If the progress of the negotiation was the sole decider, he’d probably make trip. But I just don’t see how they let that happen.

My guess is that his attorney will advise him to continue to meet all of his obligations, including going to the office, presiding over meetings, and getting on the bus to go to the charter plane. It would be the job of the KU AD to send him formal written instructions not to do so, and to not allow him on the plane. At that point, the AD will either have to designate an acting coach (no, not Lee Strasberg), or perform that role himself.
The AD might also formally inform Texas that Mangino should not have any game credentials prepared. All of this dramatically expedites the negotiations. If his buyout is as low as reported ($800k?), there really is no reason to not have a MOA today. It’s a simple negotiation- some number less than $800k, some number greater than $450k (the amount KU’s legal department would spend if there were a lawsuit), and Mangino has to decide how valuable a nice letter absolving him of the most extreme claims is worth to him. With said letter, he gets less money, absent it, he gets more.

I just want the whole saga to be over. Make the official announcement today and don’t let it hang over the game tomorrow. I don’t care what that announcement is, but let’s get the answer so we can focus on playing like we’ve got nothing to lose.

I don’t think they can officially fire him yet if they’re attempting to prove cause (I believe ’cause’ would save the University over $6 million). KU has to provide written notice to Mangino specifying the grounds for termination and provide him at least 21 days to respond to any allegations.
That’s not to say this won’t be resolved before then, but it won’t be for the buyout price of $600k. The longer Mangino draws this out, the more he will make. If nothing else, in salary alone. In reading through his contract I didn’t see anything that would freeze his salary during an investigation, which is no suprise. It’s too bad, however, that there also wasn’t anything that freezes his radio, tv, and endorsement benefits because that’s where he’s making his real money.

That would explain the protracted length of this. When UT fired Tom Penders in a similar deal, his contract called for about (from memory) $1.5 million for at-will termination. UT believed (for good reason) that they had cause, and offered … nothing. Penders lawyered up, and they settled for around $600k. Basically, the cost of avoiding going to court and to buy generic statements of no hurt feelings all the way around.

I happened to catch Mangino’s radio show last night. Didn’t sound like he was going anywhere, but you know how these shows are. Someone wrote in with a question about starting Pick and other kids to prepare for next year since this year is lost. He was miffed, but kept his cool. He asked if he should discard the seniors that worked so hard for the program. Over the course of the show he named three seniors that have meant a lot to him – Reesing, Meier, and Sharp. No black guys. Racist!
I think it’s odd that he’s no doubt gone but will be coaching the Texas game. If he’s such a bad person and leader of young men, shouldn’t be be removed from the situation immediately? Shouldn’t he have been suspended or something when the awful incident was brought to Perkins’ attention? If the incident is so bad that he could lose his job, isn’t it bad enough to suspend him so as to avoid it happening again?

Hiphop: Mangino’s salary is $229,900 and has radio, tv, and promotion services paying $1,770,100, giving him $2 million per year. He also has a $300k/year retention payment paid if he stays till 2012. You see his salary being $2.3 mil per year, though it is actually $2 mil per year since he won’t get that retention bonus.
His contract says that if he’s fired without cause he is due to get paid the remainder of his contract, which would be 3 years. Thus being $6 million.
On top of that, I’m sure he’d get some of his bonuses paid for this year. Televised games are worth $5k, if the team reaches 6 wins he gets $10k (another reason he’d want to draw this out), not to mention that would gain bowl eligibility and another $20k. If he beat Texas and missouri he’d get $30k for the wins and and extra $5k for defeating a ‘high profile opponent’ He get’s $1,000 for each player that graduates and counts towards the Univ. grad rate reported to the NCAA, (this is gray because I can’t tell if it applies to any player during the Mangino regime, or only players that graduate WHILE he is coach.) $25k if the team reaches academic goals, $10k if the program stays under budget. He also gets a bonus based on season tickets.
Keep in mind, this stuff was from his original contract, which has been amended several times to show extensions. It is possible that an entirely new contract was written in 2008 when he got his big raise. Chances are, not much changed except for values. If anything, the bonus numbers are higher.

Well, based on your first paragraph it looks like it is a done deal and just a matter of time. When the hell did Kansas decide we had to be politically correct when it comes to football? Because that is all this is. Political correctness. I can’t imagine the number of college and HS football coaches that are crapping their pants hoping this doesn’t happen to them. What BS. This is not news to Lew in any way, shape or form.
I am expecting that just because Mangino hired a lawyer that nothing will change for this weekend. And if Mangino is correct in that he has not lost the team, the boys are gonna gear up for the gipper. And we just might battle Texas in their place. Of course, if he has lost some of his starters then it will be a blood bath. I believe we will either see the proof of the allegations on the field on Saturday or see them disproved.

Reread the Contract and Amendments this morning and I think Triston is right on this, i.e., my initial thoughts were wrong (sorry hiphop). Sec. 12 of Mangino’s 2006 contract provides that if the Athletics Department terminates his contract without cause, “Athletics shall pay Head Coach his annual salary as set forth in Section 3 and all Professional Services benefits under Section 8 for the remaining term of the Agreement.”
Sec. 3 is the $229K, which is what I initially thought was all the University was responsible for. Sec. 8 is the $1.7MM. The Sec. 8 payments are contingent upon Head Coach’s participation – meaning if he isn’t coaching, he doesn’t get the money. However, Sec. 8D specifically provides that if Head Coach is terminated without cause under Sec. 12, Head Coach is entitled to all Sec. 8 payments. So it looks like without cause means ~ $6MM in buyout.
But then you get to the “for cause” section. There are a lot of reasons which constitute for cause, including discreditable conduct. (Side note: for cause proceedings must be initiated with an informal personnel investigation, i.e., the for cause proceedings started rolling Monday night.) I think this “discreditable conduct” angle is where Lew WAS hanging his hat. For cause also includes any statement that discredits the University or personnel. The “I haven’t lost any players, but I may have lost others around here” is going to end up costing Mangino about $5.1MM. My guess is Lew thought he’d have to pay for a significant buyout. But now, I would assume if everyone has lawyered up, this statement is precisely what they are fighting about.
In the meantime, Hot Toddy and the boys have a game to play on Saturday, and you can bet your ass I’ll be watching and rooting.

Trust me, I won’t claim to have any idea on this, but what am I missing? Is it simly because this is just the extension and doesn’t need to be re-stated from what’s listed in the 2006 version?

You are right. The 2008 document is simply an amendment to the 2006 contract. The amendment doesn’t change the termination provisions of Sec. 12 and 13. It just changes how much he is due under Secs. 3 and 8 and also extends the term of the contract by two years.
Without cause entitles him to compensation under Secs. 3 and 8, not just 3.

I didn’t realize Mangino’s attendance bonus was so high. He was due to get $125k if season tickets sold were over 40,000 by 9/1/09. As of 8/1/09 they were at 35,000. This is over 8 times more than his original contract ($15k for 40,000 tickets.) Even if he didn’t break 40k, and we assume his 35,000 season ticket bonus also increased 8x, then he’d get a bonus of around $80k. His bowl appearance (non New Years or BCS) bonus also jumped by $55k. Not bad.

On another note…if there were any doubt in your mind just how crazy & desperate members of the media are, let it be put to rest. Just talked to an ex-player who finally relented and gave a statement after the same outlet called him six times in an hour.

Read teh retention amendment that went into effect 1/1/2008. It states in paragraph 3 – termination without cause “shall receive a payment of $300,000 for every year head coach has been employed as coach after 1/1/2008.”
Woulnd’t this override the 2006 term w/o cause paragraph? If that is the case the buyout is less than $600,000 as they use the pro-rata amount of the remaining year if he is terminated prior to January 1.

Erik – That’s what I had thought too, but it’s unrelated. Having re-read the terms, the 300k is what he gets paid pursuant to section 3, which defines his base contract.
The additional money (roughly 1.7/yr) that we owe him come from section 8 and are defined as TV, radio, interent, endorsement, etc..

How strapped in Kansas for cash? Paying a lofty buyout won’t look good when the state is closing its judicial system one week a month to save money. I’m not saying that should stop the athletic department – Pinkel got his raise last year the same week the legislature announced a salary freeze for state employees. Shit happens.

Phenomenal: All of Mangino’s salary is privately funded and not paid for with tuition money or by the state. I’m guessing the same would apply to any buyouts. If not, yeah, it’d look very bad and it probably wouldn’t happen.

This whole thing is very un-Lew-like. I fully expected Mangino gone by now but it’s pretty obvious he’ll be coaching tomorrow. How are they going to set up a reasonable cause argument when they’re letting him continue to be around the athletes. They’re going to have to buy him out at close to the full amount if he coaches tomorrow and that’s money that could go towards the new coach. We have some ridiculously wealthy donors, but they’re not stupid. This firing looks botched to me.

I’m a bona fide Mark Mangino fan so I really hope this stuff isn’t true. That said, Herbstreit mentioned on GameDay, “Where are the other players standing up for him?” Since there don’t seem to be any guys taking his back I think you can only assume it’s true, or at least, everybody wants him gone.
I don’t know your situation but all of us in business and life know that if the boss doesn’t like you, you’re cooked, one way or the other. No one is inexpendable. Remember, Lou Holtz left ND over a tiff with the AD. The AD is the boss. If he doesn’t like you, you’re out.
I’m sad that Mangino appears to be out. It’s pretty obvious that he won’t get another shot at a head coaching job. And that’s why this is a bad thing for your program. Mangino has brought you success you hadn’t had before, and he would not have left you, even if only because his physical appearance made him unappealing for “bigger” jobs. For that reason, IMO this is not a good development for your football program. With Reesing, who I just love, and Meier graduating (Briscoe?) and a new coach, you’re truly starting over.
